New Jersey real estate investor charged with $2 million theft

The owner of a New Jersey real estate investment firm has been charged with using $2 million of his company’s money for construction at his home and other projects not related to work.

Gary Klein, owner of the Asbury Park-based REI Group Inc., surrendered himself to police after a Monmouth County grand jury indicted him on one count of theft by deception charges.

The charges were the result of a three-year investigation into his practices. Klein, 45, of Colts Neck Township, faces up to 10 years in state prison if convicted. Klein was released Friday after posting $75,000 bail.

Klein attracted clients by telling them he would invest their money in projects that would result in returns of 12 and 85 percent. Prosecutors said the actions mirrored those of a Ponzi scheme.

Robert Weir, Klein’s attorney, said the operation was not a Ponzi scheme, but legitimate business investments that went bad as the economy declined. Weir also said Klein hired a receiver to try and return the investors’ money once the investments started to go sour.

“It’s a shame that a business that experienced a turn in the real estate market is now being treated as a criminal problem. That was not Mr. Klein’s intent,” Weir said to The Star-Ledger.

Weir said the investments were used for building rehabilitation projects in Asbury Park and the construction of Florida condominium complexes, but authorities said Klein used the money to repay earlier investors who were cashing out, as well to help build his own home.

2. Some cat litter can help with sweeping up oily, grimy messes. Just spill some out over the area and let it soak up any surface excess, and then just sweep it away – simple as that.

Be sure to provide complete air flow ventilation and wear a respirator. Take about 12 oz of muriatic acid – 32% concentration, and dilute that with a gallon of regular tap water. Be sure to use rubber gloves, and a apron might not be a bad idea either.

U.S. house majority leader DeLay indicted, steps down temporarily

U.S. House of Representatives majority leader Tom DeLay was today indicted in Austin, Texas by a Travis County grand jury on conspiracy charges. DeLay announced that he will step down temporarily from his leadership position.

DeLay has publicly countered that the charges are partisan and thus politically motivated. The charges originate from the District Attorney of Travis County, Ronnie Earle, a Democrat who has prosecuted Democrat and Republican office holders, including U.S. Senator Kay Bailey Hutchison. [1]

Mr. DeLay’s attorney Steve Brittain said that DeLay was accused of a criminal conspiracy in a campaign finance scheme along with two associates, namely John Colyandro, former executive director of a Texas political action committee formed by DeLay, and Jim Ellis, the head of DeLay’s national political committee.

Attorneys for Colyandro and Ellis have filed to have the proceedings moved out of Travis County in order to obtain a fair trial. [2] Travis County, located in central Texas, contains the state capital of Austin and is politically known as a liberal county within a conservative state, as indicated by the most recent presidential elections.

According to the indictment, “the defendants herein, with the intent that a felony be committed, did enter into an agreement with one or more of each other with a general purpose committee known as Texans for a Republican Majority PAC (political action committee) that one or more of them would engage in conduct that would constitute the offense of knowingly making a political contribution in violation of Subchapter D of Chapter 253 of the Texas Election Code…” The indictment does not include specific charges of how DeLay was involved in the conspiracy. Mr. DeLay waived a three-year restriction for the indictment.

Mr. DeLay, upon announcement of the indictment, made a solitary public comment: “I have notified the speaker that I will temporarily step aside from my position as majority leader pursuant to rules of the House Republican Conference and the actions of the Travis County district attorney today.”

Earlier, DeLay denied all charges in the lengthy investigation. Bill White, another of DeLay’s attorneys, said “it’s a skunky indictment if they have one.” DeLay’s spokesman, Kevin Madden, called the indictment “nothing more than prosecutorial retribution by a partisan Democrat,” referring to prosecutor Ronnie Earle, a Democrat.

According to House Republican party rules, DeLay must resign upon indictment. Party officials told the Associated Press that Speaker of the House, Dennis Hastert R-Illinois, will likely recommend Republican David Dreier of California as replacement, while some duties may also go to Majority whip Roy Blunt, R-Missouri.

DeLay has previously been admonished three times by the House Ethics Committee. In their October 6, 2004 letter to him, the members wrote in part concluding, “…it is clearly necessary for you to temper your future actions to assure that you are in full compliance at all times with the applicable House Rules and standards of conduct. We remind you that the House Code of Official Conduct provides the Committee with authority “to deal with any given act or accumulation of acts which, in the judgment of the committee, are severe enough to reflect discredit on the Congress.” [3]

House Republicans earlier eliminated the rule requiring his resignation upon indictment, but reinstated it fearing voters’ outcry.

DeLay’s Political Action Committee, Texans for a Republican Majority, was earlier indicted on charges it accepted corporate contributions mostly from the credit card industry .[4] for use in state legislative elections. Texas law prohibits corporate money from being used in elections, permitting it only for administrative expenses.

Having gained GOP control of Texas’s legislature, DeLay masterminded a redistricting plan in 2004 that allowed the GOP to gain six seats in the U.S. House, formerly won by Democrats, and build a majority in Congress. In one case, one lawmaker switched parties, to maintain office.

Wikinews extended invitations by e-mail on March 23 to multiple candidates running in the Texas’ 6th congressional district special election of May 1 to fill a vacancy left upon the death of Republican congressman Ron Wright. Of them, the office of Democrat Daryl Eddings, Sr. agreed to answer some questions by phone March 30 about their campaigns and policies. The following is the interview with Ms Chatham on behalf of Mr Eddings, Sr.

Eddings is a federal law enforcement officer and senior non-commissioned officer in the US military. His experience as operations officer of an aviation unit in the California National Guard includes working in Los Angeles to control riots sparked by the O. J. Simpson murder case and the police handling of Rodney King, working with drug interdiction teams in Panama and Central America and fighting in the Middle East. He is the founder of Operation Battle Buddy, which has under his leadership kept in touch with over 20 thousand veterans and their families. He was born in California, but moved to Midlothian, Texas. He endeavours to bring “good government, not no government”. Campaign manager Faith Chatham spoke to Wikinews on matters ranging from healthcare to housing.

An Inside Elections poll published on March 18 shows Republican candidate Susan Wright, the widow of Ron Wright, is ahead by 21% followed by Democrat Jana Sanchez with 17% and Republican Jake Ellzey with 8% with a 4.6% margin of error among 450 likely voters. The district is considered “lean Republican” by Inside Elections and voted 51% in favour of Donald Trump in last year’s US presidential election. This is down from 54% for Trump in 2016’s presidential election, the same poll stated.

High percentage of US patients on placebos without knowing it

A new study amongst doctors in the United States on the use of placebos—pills with no medical effect—shows that almost half of the questioned practitioners prescribe placebos, most of them within the last year.

The majority of 466 faculty physicians at Chicago-area medical schools interviewed by a research group of the University of Chicago stated that placebos are useful to calm a patient down or to respond to demands for medication that the doctor disagrees with, i.e. “to get the patient to stop complaining”.

96 percent of the physicians surveyed believe that placebos can have therapeutic effects. Close to 40 percent stated that placebos could benefit patents physiologically as well as mentally.

Twelve percent of surveyed physicians think that placebos should be banned from clinical practice. Among the doctors who prescribed them, one in five said they outright lied to patients by claiming a placebo was medication. But more often the physicians came up with ways to explain like that “this may help you but I’m not sure how it works.”

The American Medical Association (AMA), the largest association of U.S. doctors and medical students, tells its members that “[p]hysicians may use placebos for diagnosis or treatment only if the patient is informed of and agrees to its use.” The research, published in Journal of General Internal Medicine this week, is the first major U.S. study of doctors on the use of placebos since 1979.

Disabled U.S. spy satellite to fall to Earth

An unresponsive United States reconnaissance satellite is in an uncontrolled, decaying orbit and will re-enter Earth‘s atmosphere in late February or early March.

According to Gordon Johndroe, a spokesman for the U.S. National Security Council, “Appropriate government agencies are monitoring the situation.”

The satellite is out-of-control, and therefore there is no possibility to guide it to re-entry over an ocean or unpopulated area. On the one hand, since most of the earth’s surface is water or unpopulated, death or property loss due to any falling fragments, which may result from the satellite entering the atmosphere, is statistically unlikely. On the other hand, it cannot be ruled out entirely. According to General Gene Renuart, of the United States Air Force, there is a chance that the satellite may re-enter over North America. After entering the atmosphere, some debris could possibly fall on land.

“Numerous satellites over the years have come out of orbit and fallen harmlessly. We are looking at potential options to mitigate any possible damage this satellite may cause,” said Johndroe.

Concerns have also been raised that some materials used in the satellite’s construction could be hazardous if they reach the ground. The satellite contains quantities of toxic hydrazine fuel, which is used for maneuvering, although this is likely to burn up on re-entry. Some of the optics aboard the satellite may contain beryllium, which is also toxic.

As the satellite was part of a classified U.S. military program, no other details, including its name, have been made public. The satellite is publicly identified by the codenames USA-193 and NRO L-21. It was launched in December 2006, by a Delta II rocket from Vandenberg Air Force Base. Ground controllers lost contact with the satellite shortly after it reached orbit. Amateur observers had been tracking USA-193 for some time, and believed that its orbit was decaying.

Cleveland, Ohio clinic performs US’s first face transplant

A team of eight transplant surgeons in Cleveland Clinic in Ohio, USA, led by reconstructive surgeon Dr. Maria Siemionow, age 58, have successfully performed the first almost total face transplant in the US, and the fourth globally, on a woman so horribly disfigured due to trauma, that cost her an eye. Two weeks ago Dr. Siemionow, in a 23-hour marathon surgery, replaced 80 percent of her face, by transplanting or grafting bone, nerve, blood vessels, muscles and skin harvested from a female donor’s cadaver.

The Clinic surgeons, in Wednesday’s news conference, described the details of the transplant but upon request, the team did not publish her name, age and cause of injury nor the donor’s identity. The patient’s family desired the reason for her transplant to remain confidential. The Los Angeles Times reported that the patient “had no upper jaw, nose, cheeks or lower eyelids and was unable to eat, talk, smile, smell or breathe on her own.” The clinic’s dermatology and plastic surgery chair, Francis Papay, described the nine hours phase of the procedure: “We transferred the skin, all the facial muscles in the upper face and mid-face, the upper lip, all of the nose, most of the sinuses around the nose, the upper jaw including the teeth, the facial nerve.” Thereafter, another team spent three hours sewing the woman’s blood vessels to that of the donor’s face to restore blood circulation, making the graft a success.

The New York Times reported that “three partial face transplants have been performed since 2005, two in France and one in China, all using facial tissue from a dead donor with permission from their families.” “Only the forehead, upper eyelids, lower lip, lower teeth and jaw are hers, the rest of her face comes from a cadaver; she could not eat on her own or breathe without a hole in her windpipe. About 77 square inches of tissue were transplanted from the donor,” it further described the details of the medical marvel. The patient, however, must take lifetime immunosuppressive drugs, also called antirejection drugs, which do not guarantee success. The transplant team said that in case of failure, it would replace the part with a skin graft taken from her own body.

Dr. Bohdan Pomahac, a Brigham and Women’s Hospital surgeon praised the recent medical development. “There are patients who can benefit tremendously from this. It’s great that it happened,” he said.

Leading bioethicist Arthur Caplan of the University of Pennsylvania withheld judgment on the Cleveland transplant amid grave concerns on the post-operation results. “The biggest ethical problem is dealing with failure — if your face rejects. It would be a living hell. If your face is falling off and you can’t eat and you can’t breathe and you’re suffering in a terrible manner that can’t be reversed, you need to put on the table assistance in dying. There are patients who can benefit tremendously from this. It’s great that it happened,” he said.

Dr Alex Clarke, of the Royal Free Hospital had praised the Clinic for its contribution to medicine. “It is a real step forward for people who have severe disfigurement and this operation has been done by a team who have really prepared and worked towards this for a number of years. These transplants have proven that the technical difficulties can be overcome and psychologically the patients are doing well. They have all have reacted positively and have begun to do things they were not able to before. All the things people thought were barriers to this kind of operations have been overcome,” she said.

The first partial face transplant surgery on a living human was performed on Isabelle Dinoire on November 27 2005, when she was 38, by Professor Bernard Devauchelle, assisted by Professor Jean-Michel Dubernard in Amiens, France. Her Labrador dog mauled her in May 2005. A triangle of face tissue including the nose and mouth was taken from a brain-dead female donor and grafted onto the patient. Scientists elsewhere have performed scalp and ear transplants. However, the claim is the first for a mouth and nose transplant. Experts say the mouth and nose are the most difficult parts of the face to transplant.

In 2004, the same Cleveland Clinic, became the first institution to approve this surgery and test it on cadavers. In October 2006, surgeon Peter Butler at London‘s Royal Free Hospital in the UK was given permission by the NHS ethics board to carry out a full face transplant. His team will select four adult patients (children cannot be selected due to concerns over consent), with operations being carried out at six month intervals. In March 2008, the treatment of 30-year-old neurofibromatosis victim Pascal Coler of France ended after having received what his doctors call the worlds first successful full face transplant.

Ethical concerns, psychological impact, problems relating to immunosuppression and consequences of technical failure have prevented teams from performing face transplant operations in the past, even though it has been technically possible to carry out such procedures for years.

Mr Iain Hutchison, of Barts and the London Hospital, warned of several problems with face transplants, such as blood vessels in the donated tissue clotting and immunosuppressants failing or increasing the patient’s risk of cancer. He also pointed out ethical issues with the fact that the procedure requires a “beating heart donor”. The transplant is carried out while the donor is brain dead, but still alive by use of a ventilator.

According to Stephen Wigmore, chair of British Transplantation Society’s ethics committee, it is unknown to what extent facial expressions will function in the long term. He said that it is not certain whether a patient could be left worse off in the case of a face transplant failing.

Mr Michael Earley, a member of the Royal College of Surgeon‘s facial transplantation working party, commented that if successful, the transplant would be “a major breakthrough in facial reconstruction” and “a major step forward for the facially disfigured.”

In Wednesday’s conference, Siemionow said “we know that there are so many patients there in their homes where they are hiding from society because they are afraid to walk to the grocery stores, they are afraid to go the the street.” “Our patient was called names and was humiliated. We very much hope that for this very special group of patients there is a hope that someday they will be able to go comfortably from their houses and enjoy the things we take for granted,” she added.

In response to the medical breakthrough, a British medical group led by Royal Free Hospital’s lead surgeon Dr Peter Butler, said they will finish the world’s first full face transplant within a year. “We hope to make an announcement about a full-face operation in the next 12 months. This latest operation shows how facial transplantation can help a particular group of the most severely facially injured people. These are people who would otherwise live a terrible twilight life, shut away from public gaze,” he said.

One dead in Michigan school shooting

At least one person is seriously wounded and one dead after a 17 year-old male opened fire and shot his ex-girlfriend, Jessica Forsyth, 17, four times outside the Herbert Henry Dow High School located in Midland, Michigan before turning the gun on himself. The shooter was pronounced dead on the scene and according to Midland Police Chief, James St. Louis, the shooter died in the parking lot of the school while the girl is in a local hospital. She is said to be in stable but serious condition at Hurley Medical Center in Flint, Michigan.

Chief St. Louis says that the boy pulled out a gun and began to shoot the girl after the two had a conversation. He then shot himself. St. Louis also said that the mother of the girl, who had dropped her daughter off at school for the day, tried to stop the incident from happening by driving her car in between the girl and boy, but was not successful. The boy, whose name is not known, apparently had stored the gun inside his backpack.

According to Midland Deputy Chief, Bob Lane, the boy was not a student at the school and was not granted access into the school. Lane also stated that the boy then placed a phone call to Forsyth telling her to meet him outside the school just before 11:00 a.m. [EST].

The school hosts nearly 1,500 students. The school was in lockdown, but according to a statement on the school’s website, the lockdown was cancelled.

“This morning a shooting incident took place at Dow High outside the building near the cafeteria. A Code Red lock-down was issued, but has been lifted,” said the statement.
