Facts:

The defendant appealed from the judgment of the Circuit Court of the City of Hopewell (Virginia), which, after a bench trial, convicted her of reckless Hopewell Police Officer testified he arrived at the designated location and found appellant’s car stopped in a heavily travelled area and that the appellant was “passed out behind the wheel. The police officer opined that appellant’s car was a traffic hazard which posed a threat to appellant’s safety and to the safety of other motorists. However, he never saw the car in motion prior to or during his investigation and he confirmed that he had not observed appellant driving the vehicle. The appellant told him she was headed home to Chesterfield while the direction of her vehicle was such that she was really “coming from Chesterfield. A strong odor of alcohol was escaping from the vehicle and there were two open alcoholic beverage containers therein. Appellant admitted she had been drinking. The prosecutor elected not to proceed on the charge for which appellant was arrested and amended the charge to reckless driving.

Issue:

Whether the evidence was sufficient to prove beyond a reasonable doubt that defendant drove a vehicle recklessly on a highway in violation of Va. Code Ann. 46.2-852.?

Discussion:

This court held that the circumstances in which the police officer found appellant’s car were such as to give rise to an inference that appellant drove her car to the location where the police officer found her. In fact, it has been held in similar circumstances that a defendant could be convicted of driving or operating a motor vehicle while intoxicated. However, the circumstances in appellant’s case do not give rise to an inference that she drove her car in a reckless manner. To support a conviction for

reckless driving

in violation of Code 46.2-852, the Commonwealth must prove beyond a reasonable doubt that the accused drove the vehicle in a reckless manner “so as to endanger the life, limb, or property” of another.The essence of the offense of reckless driving lies not in the act of operating a vehicle, but in the manner and circumstances of its operation. this court held that under the facts shown by this record, the Commonwealth has failed to prove beyond a reasonable doubt that appellant was guilty of reckless driving in violation of Code 46.2-852.

Conclusion:

This court hence found that the evidence was insufficient and reversed the conviction

Greenspan’s testimony suggests “more of the same”

Alan Greenspan, Chairman of the Federal Reserve has suggested that there will be more of the same in coming months from the Fed. In his speech during testimony before the U.S. Senate Banking Committee on Wednesday, Mr. Greenspan noted that the economic fundamentals of the U.S. appeared to be stable. On Thursday, Greenspan spoke before the U.S. House Committee on Financial Services and when faced with questions regarding Social Security reform issues, he hinted that he was in favour of partial privatization of Social Security – but the general consensus on Wall Street is to expect more of the same.

However, economic advisors were somewhat disappointed that most of the testimony in both speechs was focused on the upcoming Social Security reform and did not address monetary policy as broadly as they’d hoped. Mike Moran, chief economist at Daiwa Securities America Inc, is quoted in the Investors Business Daily as saying “Chairman Greenspan provided few explicit insights into his plans for monetary policy.”

Greenspan reiterated his concerns about market reactions to the burgeoning federal deficit. “We are not sure to what extent and how much the market will respond,” he said.

Parsing Greenspan’s reports to Congress is a Wall Street obsession, but the general consensus from his recent testimony is to expect little change in the current Fed policy. Economists expect “measured” hikes to the central bank’s short-term interest rates from the next few meetings of Fed policy-makers.

“In my view the bottom line is that we are in for more of the same,” said Steve Stanley, chief economist at RBS Greenwich Capital to the Associated Press.

Joey Logano wins his first NASCAR Sprint Cup race of 2016

On Sunday, Team Penske driver Joey Logano claimed his first NASCAR Sprint Cup Series win of the 2016 season in the FireKeepers Casino 400 at the Michigan International Speedway in Brooklyn, Michigan. The 200-lap race began with Logano starting from the pole position, and featured nine cautions and fourteen lead changes between eight different drivers.

Despite starting first, Logano was quickly overtaken on the first lap by Furniture Row Racing driver Martin Truex Jr. Truex led the race until Logano reclaimed the first position on lap ten, a position he would keep until the the first cycle of green flag pit stops around lap 40. Logano’s teammate Brad Keselowski took the lead during the pit stop cycle by staying out on the track. Keselowski, low on gasoline, led until a caution came out for a spin by Truex around lap 46. During the caution, Keselowski pitted and returned the lead back to his teammate, who led the race until lap 93.

Two other cautions slowed the race between the first caution and lap 93. The first occurred when Kyle Busch’s engine failed around lap 53, forcing the driver to a last-place finish in the race. The other caution was caused by contact between the cars of Chris Buescher, Dale Earnhardt Jr., and A. J. Allmendinger ten laps later. Between laps 93 and 103, Kyle Larson, Ryan Newman, Keselowski, Jimmie Johnson, and Paul Menard led at least one lap. Logano returned to the lead on lap 104, a few laps before a caution when Jeffrey Earnhardt’s car caught fire. After the caution, Logano remained in first until Hendrick Motorsports driver Chase Elliott passed him on lap 117.

Elliott kept the lead until lap 149, when he was briefly passed by Logano. Elliott retook the lead for three more laps on lap 150 before returning the lead back to Logano, who led until the seventh caution was called around lap 156 for of a collision between Danica Patrick, Brian Scott, and Casey Mears. Logano held the lead on the ensuing restart and led through two more caution periods that were called in the final 50 laps. The first began around lap 164 because of a collision involving Johnson, Trevor Bayne, and Ryan Blaney, while the final caution of the race was called with about ten laps remaining after Denny Hamlin suffered a tire puncture on the front straightaway and collided into the SAFER barrier. On the final restart, Logano retained the first position and led the remainder of the race to capture the fifteenth win of his career.

After the race, Logano, who led a race-high of 138 laps, praised his team, saying “Team Penske gave me a great race car. Everyone did a great job figuring out exactly what this car was going to do. This is Ford’s backyard, Roger [Penske]’s backyard; this is a great win”. Elliott, who finished second in the race, expressed disappointment with his result, claiming he “messed up” by not using the correct gear. Larson, Keselowski, and Kevin Harvick completed the top-five finishers, while Carl Edwards finished in the sixth position. Tony Stewart finished seventh ahead of Austin Dillon and Jamie McMurray, who finished eighth and ninth. Kurt Busch completed the first ten positions with a tenth-place finish. In post-race inspection, Larson’s car did not pass laser inspection, prompting NASCAR to impound his car so it can be further evaluated. Any possible penalties are to be announced in the next week.

In the drivers’ championship, Harvick led Kurt Busch and Keselowski with 526 points. Edwards and Logano were fourth and fifth with 472 and 455 points. Elliott was sixth with 453, followed by Johnson with 441. Truex was scored eighth ahead of Kyle Busch and Matt Kenseth, who completed the top-ten. The 2016 season is scheduled to continue on June 26 with the Toyota/Save Mart 350 at Sonoma Raceway.

Nigerian parliament votes to make vice president acting president

Goodluck Jonathan, vice-president of Nigeria, has become the country’s acting president after president Umaru Yar’Adua travelled to Saudi Arabia last November to receive medical treatment for a heart condition.

In a televised address, Jonathan commented, “I am fully aware of the responsibilities reposed in me, and I want to reassure all Nigerians that this is a sacred trust, which I shall discharge to my fullest abilities. […] The circumstances — in which I find myself assuming office today as acting president of our country — are uncommon, sober and reflective.”

He added, “[m]ore than ever therefore, I urge all Nigerians as a people who have faith in God to pray fervently for the full recovery of our dear president, and his early return”.Yesterday saw both houses of the Nigerian National Assembly approve a motion for Jonathan to become president until Yar’Adua is able to return. Under the country’s constitution, executive power can be transferred when parliament is formally informed by the president that he is absent. Yar’Adua apparently had not done so; however, senate leader David Mark said that Yar’Auda’s comments in an interview with the BBC last month were sufficient notice.

Some political analysts, however, have indicated the assembly’s move might not be legally binding, and could face a court challenge.

Many companies would like to go paperless to reduce cost. Some companies may choose electronic storage to reduce the physical space required to store paper forms. Reducing cost, saving time, and insuring accurate completion of the form are the main reasons a company chooses electronic storage. Some employers may choose to complete a paper version of the I-9 Form and scan and save it. This is the simplest version of electronic storage. If your company chooses this method, once you have securely stored the I-9 Form in electronic format, you may destroy the original paper Form I-9.Electronic Employment Elibigility Verification According to USCIS (U.S. Citizenship and Immigration Services), you may complete or retain the Form I-9 in an electronic generation or storage system that includes: 1. Reasonable controls to ensure the integrity, accuracy, and reliability of the electronic storage system; 2. Reasonable controls designed to prevent and detect the unauthorized or accidental creation of, addition to, alteration of, deletion of, or deterioration of an electronically completed or stored Form I-9, including the electronic signature, if used; 3. An inspection and quality assurance program that regularly evaluates the electronic generation or storage system, and includes periodic checks of electronically stored I-9 Forms, including the electronic signature, if used; 4. A retrieval system that includes an indexing system that permits searches by any data element; and 5. The ability to reproduce legible paper copies. USCIS also allows electronic signatures if you complete I-9 Forms electronically. When a company chooses to use an electronic signature, the system for capturing electronic signatures must allow signatories to acknowledge that they read the attestation and attach the electronic signature to an electronically completed Form I-9. The system must: 1. Affix the electronic signature at the time of the transaction; 2. Create and preserve a record verifying the identity of the person making the signature; and 3. Provide a printed confirmation of the transaction, at the time of the transaction, to the person providing the signature. If you do not comply with the standards for capturing signatures electronically, ICE (Immigration and Customs Enforcement) will determine that you have not properly completed Form I-9, in violation of section 274A(a)(1)(B) Use these 25 questions when considering any paperless electronic storage system to help guide you toward an informed decision. The Form I-9 – 25 Questions Concerning Electronic Storage Systems 1) How secure is the system? Remember, you are storing very vital personal information on each Form I-9. Does it meet the criteria set forth by USCIS? 2) Where is the information stored? Is it on your company network or is it an on-line storage system? 3) What type of back-up is in place to ensure data is never lost even in the event of a natural disaster such as flood or tornado? 4) Who will have access to the information stored in the system? Does the system have an audit log to record every time a record is accessed and who accessed it? 5) If requested by ICE, will you be able to produce all current employees I-9 Forms and all terminated employees I-9 Forms going back 3 years time within 3 business days? 6) If you cannot produce the documents according to a legitimate Government request within 3 days, does the software/system provider have insurance to cover your companys losses and fines for failure to produce within the time allowed? 7) What provisions are in place in the system for complying with various State specific employment verification issues? 8) What provisions are in place to handle the Form I-9 if an employee is transferred to a new location? 9) Does the program have a tickler system to remind you when I-9 Forms need updating when work authorization documents expire that are necessary to re-verify? 10) Does the program provider offer a training program for field agents who will be completing the Form I-9? 11) Does the provider offer training concerning the use of E-verify and /or SSNVS (Social Security Number Verification Service)? 12) Who will observe the prospective employee complete Section 1 of the Form I-9? 13) Who will observe the prospective employees physical appearance and identity documents to ascertain they appear to be the documents of the individual who is presenting them? 14) Can an applicant complete the form without including his/her Social Security number in Section 1? 15) Is there a place in the system to store the date of termination? 16) What provisions are in place for updating the Form I-9 when an employee changes their name for payroll purposes? 17) How are the ID and work authorization documents produced by the employee stored? 18) Can the system store the confirmation or non-confirmation returned by E-verify? 19) Are you able to store SSNVS results? 20) Are there provisions in place to handle special circumstances such as; a. An employee who enters the US on an L-1A and E-verify will not certify they are eligible to work? b. What do you do when a new hire shows a Native American card and E-verify will not certify them? c. What do you do when a foreign worker applies for a Social Security number and is rejected by the SSA without a receipt because their system does not yet have his or her entry into the US? d. If an employee is rejected because he or she presented documents that did not match the E-verify document, such as an I-551, and the same applicant comes back with a new name and new documents and passes E-verify, how is it processed? 21) Does the system provider have insurance to cover losses if, as a result of their system, a person is successful in collecting double wages at USDOJ/OSC because the applicant was not hired? 22) Does the system provider offer advice about policies that should be in place to keep the system current with government standards? 23) Does the provider recommend the use of IMAGE (Ice Mutual Agreement with Employers)? 24) Does the provider train clients on how to recognize fake identity documents? 25) If a new hire presents a Green Card, what number from the I-551 (lawful permanent resident card) does the system require in Section 2, List A? Television producer and owner of the anti-Scientology website www.xenutv.com (XenuTV), Mark Bunker, also known as Wise Beard Man, chatted online with Wikinews for nearly three hours. More than 120 people followed the interview live (many from Project Chanology), which makes this exclusive Wikinews interview our most attended IRC interview to date.

Bunker started XenuTV in 1999 and began to make videos that he provided for the Lisa McPherson Trust. Bunker has been a critic of the Church of Scientology since 1997.

In 2006, he won a Regional Emmy Award after he and KUSI-TV news reporter Lena Lewis produced a documentary news video on the issues with the United States – Mexico border with San Diego, California.

Copiapó, Chile mining accident: in depth

The rescue of the Chilean miners trapped in the San José Mine in Copiapó, codenamed Operación San Lorenzo (San Lorenzo Operation), began on Tuesday night, at around 20:00 local time (23:00 UTC).

Florencio Ávalos was the first miner to be rescued, at 00:12 local time (03:12 UTC) on Wednesday. He was wearing a shirt signed by all his fellow miners. “The first miner is already with us. We saw it all, him hugging his wife Monica and his son Byron,” said President Piñera shortly after the first rescue. “We still have a long journey.”

“This will be recorded on every single Chilean heart forever,” Piñera added. “I hope the miners’ hope stay with us, just like the [February] earthquake victims’ [hope] and what the earthquake took off. We know that the disasters unite us all.”

All the 33 miners were rescued. The last miner, Luis Urzúa, was rescued at 21:55 Chile time (00:55 UTC). “It is a pleasure to be Chilean, [I’m] proud,” said Luis Urzúa to President Piñera. “In honour of the miners, their families, the rescuers […] let’s sing our national anthem. Viva Chile Mierda!,” said Piñera. Urzúa thanked Mining Minister Golborne and the First Lady Cecilia Morel for “fighting for their lives.” “I’m proud of my fellow miners,” Urzúa added.

Six rescuers, including a miner and a paramedic, descended to the miners’ shelter using the Fénix 3 capsule which was specially constructed for the rescue. They performed check-ups and talk with the miners before taking them back to the surface. The rescuers still don’t leave the mine.

The Fénix 3 capsules are 3.95 metres in height and weigh about 460 kilograms. They have an armour, an oxygen tube and a microphone. The occupants helmets contain an intercom to keep them in contact with the rescue team on the surface.

President of Chile Piñera assisted to the rescue. Bolivian President Evo Morales could not attend Carlos Mamani’s rescue. Mamani is the only Bolivian miner in the group.

A mass for the miners was conducted at 18:00 local time (21:00 UTC). The rescue takes between 15 and 20 minutes for each miner.

On Tuesday, Mayor of Copiapó Maglio Cicardini announced that the municipal schools in the city will have no classes this Wednesday “to transform the rescue of the Atacama’s 33 in a familiar meeting,” Radio Cooperativa reported.

“The miners will be taken to the Copiapó Regional Hospital for medical checkup, where they will have to stay for 48 hours,” Health Minister Mañalich said to Televisión Nacional de Chile.

Celebrations are taking place in several Chilean cities. In Santiago de Chile, people gathered in one of the most important points of the city, Plaza Italia. In Pichilemu, tens of cars are passing over its most important streets. In Copiapó, people gathered in its main square to assist a massive concert.

On August 5, 33 miners were trapped more than 700 meters (2,300 ft) underground, in the San José copper–gold mine, located about 40 kilometers north of Copiapó, Chile.

The youngest trapped miner is 19 years old, and the oldest is 63. There were several rescue attempts before reaching the miners’ shelter on August 22. The National Emergencies Office of Chile (ONEMI) released a list of the trapped miners on August 6, which included Franklin Lobos Ramírez, a retired footballer.

Chile is the worlds top producer of copper, according to The Economist. The San José Mine is owned by the San Esteban Mining Company (Empresa Minera San Esteban). The mine was closed down in 2007, after relatives of a miner who had died sued the company executives, but the mine was re–opened in 2008.

It was originally estimated that “it would take three to four months to complete the rescue of the trapped miners”. There were three plans to reach the miners: “Plan A” using a Strata 950 drill, “Plan B” using a Schramm T130XD drill, and “Plan C” using a RIG-422 drill. The first to reach the miners was “Plan B”, early on Saturday 9.

The last step of their rescue, announced by Health Minister Jaime Mañalich, was originally due to begin on Tuesday. Laurence Golborne, Minery Minister said “If it is possible, and the cement sets before and we don’t have any impediments to doing it, it would be wonderful,” in a press conference on Monday. The men will be extracted in a steel rescue capsule 54 cm (21 inches) in diameter.

On September 4, Chilean filmmaker Rodrigo Ortúzar announced plans to film a movie about the accident, called “Los 33” (“The 33”). The film will be released in 2011.

One miner is Bolivian, and the other 32 are Chilean.

Raúl Bustos, 40 years old, is an hydraulics engineer. He left his job in Talcahuano after the February 27 earthquake to work in the mine.

Daniel Herrera, 27 years old, is a lorry driver. He has acted as paramedic assistant in the mine. He said to La Tercera “the miners were unhappy with the psychologist in the rescue team.”

Claudio Acuña, miner, is fan of the Colo-Colo football club. The BBC reports he is aged 56, but El Comercio says he is 44.

Pedro Cortez is aged 24. He joined the mine with his friend Carlos Bugueño. Cortez is an electrician, and lost a finger in the mine a year ago.

A native of Los Lagos, Juan Aguilar is 49 years old. Aguilar is married to Cristy Coronado, according to El Comercio. Aguilar works as a supervisor.

Mario Sepúlveda is a 39 years old electrician native of Parral; he is married. He has been the spokesman of the most of the miners’ videos. Mario Sepúlveda was the second miner to be rescued, on Wednesday at 01:10 local time (04:10 UTC).

Víctor Zamora is a 33 years old auto mechanic. Zamora is married to Jéssica Cortez, who confirmed she was pregnant while he was in the mine.

Osman Araya is 30 years old, and married. He began working as miner four months before the accident.

Florencio Ávalos is 31 years old. He is the brother of Renán Ávalos, who is also trapped in the mine. He worked as driver in San José. Ávalos filmed videos, sent later to his relatives.

Ávalos was the first miner to be rescued, on Wednesday at 00:10 local time (03:10 UTC).

Jorge Galleguillos, 56 years old, has worked all his life in the mine. He said in one video he was feeling unwell; he takes medication for hypertension.

Carlos Barrios is a 27 years old miner. His father, Antenor Barrios, told Agence France-Presse: “I find he’s very strong and has enthusiasm. He spoke loud and clear. I was excited.”

Franklin Lobos Ramírez is a 53 years old retired footballer. He played for Cobresal, Deportes Antofagasta, Club de Deportes Santiago Wanderers and Unión La Calera, and briefly for the Chile national football team. Lobos had worked as a truck driver in the mine.

Yonni Barrios, called “The Doctor”, is a 50 years old electrician. He has knowledge of first aid, and was given responsibility for monitoring the health of his colleagues. “I felt I was in hell,” Barrios said in a letter to his wife.

Carlos Bugueño, 27 years old, joined the mine with Pedro Cortez. Previously, he worked as a watchman.

Alex Vega Salazar is a 31 years old heavy machinery mechanic. He is married to Jessica Salgado, and celebrated his birthday in the mine on September 22.

Ariel Ticona is a 29 years old miner. His wife, Margarita gave birth to his daughter on September 14. She was named Esperanza (Hope), at Ticona’s request.

Richard Villarroel is a 27 years old mechanic from Coyhaique.

Edison Peña is a 34 years old miner. “I want to go out soon,” he said on his first contact with his relatives. “I want to be free, I want to see the sun,” he added. He is a fan of Elvis Presley.

Claudio Yáñez is 34 years old, and works as drill operator.

José Ojeda, 46 years old, is the master driller. Ojeda is widowed and diabetic.

Luis Urzúa is a 54 year old topographer. He is the shift-leader, and was the first miner to talk with authorities. He is known as Don Lucho among the miners. He draw plans of the area of the mine where they are trapped.

Urzúa will be the last miner to leave the mine.

José Henríquez is a 54 years old drill master. He is also an evangelical preacher, and has worked in mines for 33 years.

U.S. Senator calls for nationwide investigation into Army recruitment tactics

U.S. Senator Wayne Allard (RColorado), in a letter to Army Secretary Francis Harvey, said that the secretary of the Army should launch a nationwide investigation into reports that some Army recruiters engaged in questionable recruiting tactics. In the letter Allard wrote that “according to these reports, the rules weren’t just bent, they were broken and tossed away.”

One of the reports the Senator is referring to is the attempted recruitment of David McSwane, a 17 year old editor of a high school newspaper in Golden, Colorado. McSwane posed as a high school dropout, with a drug problem that he was “unable to kick”. Then he recorded, on audio tape, conversations allegedly showing that the recruiters told him how to obtain a phony diploma on the Internet and what medication to buy to cover up the drug problem. A friend of McSwane’s also video-taped a recruiter taking McSwain to a store to buy a “detox” medication to help him pass the army physical. David said he was told by the recruiter to buy the product.

A voice on the audio tape is heard saying, “You just have to follow instructions to a tee. It has got like a 150 percent guarantee that you will pass. You know, I’ve seen it work before.”

“If I were a soldier out on the front line, I wouldn’t want someone next to me who my life could be depending on going through withdrawal or having a drug addiction or just being someone I can’t trust. I just don’t think that’s something we need on our front lines,” David McSwane said on CNN.

His mother, concerned that people may think he was being unpatriotic by setting up the “sting” operation said: “He’s probably one of the most patriotic kids I know. He was in the Young Marines for almost a year and earned a couple (of) awards.”

Major General Michael Rochelle, the general in charge of recruiting for the U.S. Army responded to the allegations and tapes. “I was disappointed by it,” Rochelle said. “I was very disappointed by it.” He is shutting down recruiting offices for 1 day to review their procedures.

Jim Massey, a former Marine recruiter, expanded the accusations by saying the same fraudulent recruitment practices existed in the United States Marines Corps.

“This isn’t just an isolated incident,” Massey said. “This is a widespread epidemic. I would say 98 percent [of the recruits Massey enlisted] were frauded into the military.”

The Army has suspended two recruiters in Golden, Colorado.

Thai anti-government leaders escape capture

In a new setback to the Thai government’s efforts to ease mounting political tensions, protest leaders escaped from their hotel Friday after security forces arrived to arrest them.

One, Arisman Pongruangrong, climbed down three floors using a rope, and was rushed away by supporters thronging the building. The police say Arisman led recent rallies at the national parliament, the election commission, and satellite transmission bases.

Officials earlier Friday said the government is preparing to arrest people linked to violent clashes with security forces last Saturday.

Deputy Prime Minister Suthep Thaugsuban, Thai security chief, announced the raid on the hotel as it was unfolding, saying that a Special Forces unit had closed in around a downtown Bangkok hotel.

“As I am speaking, the government’s special team is surrounding the SC Park Hotel, where we have learned that there are terrorists and some of their leaders hiding,” Suthep said.

A spokesman for the governing Democrat Party, Baranuj Smuthararaks, says arrest warrants have been issued for those suspected of being involved in the violence. Some of the suspects have been identified from photos taken during the clashes.

“Right now the government’s focusing on issuing warrants for acts of terrorism by the people who fortunately have been captured in action [in photos] by both the local and international media,” he said.

According to the New York Times, as many as five protest leaders had been staying at the same hotel as Pongruangrong. Those leaders later appeared together at a protest rally in Bangkok.

“I would like to thank all of the people who saved me,” Arisman said. “You have saved democracy.”The government says armed men infiltrated protester ranks Saturday and fired on troops trying to disperse a rally. Five soldiers and 19 protesters died during the clashes.

Thailand is facing its most severe political crisis in almost 20 years. The anti-government movement, led by the United Democratic Front against Dictatorship or UDD, demands that the government step down and call fresh elections.

UDD supporters, known as red shirts, have held protests in Bangkok for more than a month.

The UDD largely supports former Prime Minister Thaksin Shinawatra, who was ousted in a coup in 2006 and remains overseas to avoid a jail sentence for corruption. Mr. Thaksin has strong support among the rural and urban poor, as well among some sections of the army and police.

Some parties in the governing coalition want to set a clear time frame for elections to ease tensions. But the government says it will only call elections once the political situation has cooled.
